Who we are and what this covers
Darkhorse Traders LLC ("Darkhorse", "we", "us") operates Agent Visibility Report (the "Service") at agentvisibilityreport.com. These Terms cover the free scan, the Full Report, the Rebuild (Report + Fix Plan), the Fix Plan upgrade and anything else we provide through the Service. By requesting a scan, buying, or using a report, you agree to these Terms. If you act for a team or company, you confirm you can bind it.
The Service is for real estate professionals in the United States. You must be 18 or older.
What the Service does, and what it does not do
The Service asks AI assistants (currently ChatGPT and Claude, with web search turned on) questions that home buyers and sellers ask about your market, saves the answers exactly as they came back, records who was named, checks what is publicly visible about you online, and gives you our analysis and a list of fixes. The Rebuild adds written copy (bios, area pages, review-request messages and a profile checklist) based on an interview you complete.
Every report is an observed snapshot: what those assistants said on the dates shown. The same question can get a different answer tomorrow, in another place or in another account. Our scores and findings are automated analysis and opinion, reviewed by a person before paid reports are delivered. They are not a guarantee of anything.
We do not and cannot guarantee that any AI product will name you, rank you, recommend you or send you business. We make no promise about leads, listings, transactions or income, and nothing on the Service is an earnings claim.
AI-generated content and accuracy
Parts of each report and Fix Plan are produced with AI tools. AI output can be incomplete or wrong, and web search can miss things that exist (for example, reviews on sites that block AI search). We label what was observed, we never edit an AI answer to look better, and a person reviews paid deliverables, but you should check anything before relying on it. If something we wrote about you is factually wrong, tell us and we'll correct it.
Your information and your approval
You give us accurate information and only facts you can back up. We draft Fix Plan copy only from your interview answers and what the report observed. We never invent sales figures, reviews, awards, designations or credentials.
Nothing is published to your website or profiles by us. You decide what to use, and you are responsible for what you publish, including your state license law, your brokerage's advertising rules, MLS rules and Fair Housing law. FOR ATTORNEY REVIEW: confirm the allocation of responsibility for published copy.
What you can do with your report and Fix Plan
Once paid, you may use your report and Fix Plan copy for your own real estate business, including publishing the copy on your own website and profiles and sharing the report with your brokerage or web person. You may not resell reports, sell the Service's output as your own product, or publish other people's reports. Our methods, software, design and templates remain ours.
Acceptable use
Please follow our Acceptable Use rules. In short: only scan yourself or someone who has asked you to, don't scrape or automate the Service, and don't submit false information.
Fees and payment
Prices, delivery times, refunds and the Full Report guarantee are in Billing & Refunds, which is part of these Terms. Payments are processed by Stripe.
Our property
The Service, its software, report design, scoring methods and written templates belong to Darkhorse Traders LLC. "Agent Visibility Report" and our logo are our marks. Other names mentioned (OpenAI, ChatGPT, Anthropic, Claude, Google, Zillow, Realtor.com and others) belong to their owners. We are not affiliated with or endorsed by them or by any brokerage.
Availability and changes
We work to keep the Service available but don't promise it will be uninterrupted. AI providers change their products and their answers; we may change the questions, assistants or methods we use to keep reports useful.
Disclaimers
FOR ATTORNEY REVIEW. Except as stated in Billing & Refunds, the Service and all reports are provided "as is" and "as available". To the fullest extent the law allows, we disclaim all implied warranties, including merchantability, fitness for a particular purpose and non-infringement, and any warranty that AI products will treat you in any particular way.
Limit of liability
FOR ATTORNEY REVIEW. To the fullest extent the law allows, Darkhorse Traders LLC is not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, lost business or lost opportunities. Our total liability for any claim relating to the Service is limited to the amount you paid us for the Service in the 12 months before the claim.
Your indemnity
FOR ATTORNEY REVIEW. You agree to defend and indemnify Darkhorse Traders LLC against claims arising from information you gave us, content you publish, or your breach of these Terms or the law.
Law and disputes
These Terms are governed by the laws of the State of Arizona, without regard to conflict-of-law rules. Any dispute will be brought in the state or federal courts located in Pima County, Arizona, and you and we consent to their jurisdiction. Please contact us first; most problems are sorted out by email. FOR ATTORNEY REVIEW: consider an informal-resolution period and whether to add arbitration or a class-action waiver.
Changes to these Terms
We may update these Terms. The version and date at the top show which version applies. Changes apply to purchases made after the update; for anything you've already paid for, the version in force when you paid applies.
